The parliamentary panel reviewing the Waqf Bill today broadcast the 655-Page report, including all the changes suggested by its members. However, the opposition has alleged that none of its amendments have been included.

It is feared that the existing Waqf properties will be subject to investigation after the amended law is implemented, the committee has recommended that no cases against such assets will be reopen yes .

The committee has accepted 14 amendments, suggested by members of BJP or its allies.

The bill proposes several changes in the way the Waqf boards administer the Waqf boards, including the nomination of non-Muslim and (at least two) female members.

There is also a provision in the bill stating that the Central Waqf Council should include one Union Minister and three MPs, two former judges, four people of ‘National Famous’, and senior government officials, any of which any of which is Islamic Faith is not required.

In addition, the Waqf Council cannot claim land under the new rules.

Opposition leaders have also criticized that the committee has alleged at a very short time that the draft report has been given very little time to study.

The report is expected to be adopted on Wednesday under the chairmanship of BJP leader Jagdambika Pal.

Major provisions of the WAQF Amendment Bill, 2025

  • Two Muslim women will be included as members in both state WAQF boards (Section 14) and Central WAQF Council (Section 9) to ensure participation in Muslim women empowerment and WAQF management.
  • State WAQF boards will now include a member of the Muslim OBC community, which will ensure comprehensive representation (Section 14).
  • The state government may set up a separate Waqf board for Agakhani and Bohra communities, accepting its specific religious requirements (Section 13).
  • In Waqf Alal Aulad (Family Waqfs), women’s rights will be protected. An assurance can only dedicate the property only after ensuring that women successors get their correct part (Section 3A (2)).
  • The WAQF registered by the user will be recognized as WAQF, except in cases where property is owned by dispute or government (Section 3 (R)).
  • The Border Act will apply to matters related to all Waqf from the beginning of this Act, ensure timely resolution and prevent prolonged litigation (section 107).
  • The online registration process will be initiated to automate the entire life cycle of WAQF properties through the portal.
  • WAQF boards will have to upload all WAQF property details on a central portal within six months. The Waqf Tribunal can give extensions based on the case-case.
  • If a government property is claimed as Waqf, an officer above the post of Collector notified by the state government will conduct an inquiry according to the law. Such government properties will not be considered as Waqf (Section 3C) until the report is submitted.
  • Muslim trusts that do the same function as Waqf, but are ruled by trust laws, will be excluded from the Waqf Act, 1995, which prevents legal conflicts (Section 2A).
  • Income from Waqf Alal Aulad can be used to support widows, divorced women and orphans, if specified by Waqif (Section 3 (R) (IV)).
  • The immunity of tribunal decisions has been removed. Any aggrieved person can now appeal to the High Court within ninety days of the tribunal’s decision.
  • Online registration certificates of WAQF properties will be issued through portal.
