New Delhi: Wednesday i.e. 10th July was a very special day for divorced Muslim women. The Supreme Court on Wednesday said that a divorced Muslim woman is entitled to maintenance from her husband under Section 125 of the Criminal Procedure Code (CrPC) (now Section 144 of the Indian Civil Defense Code). This decision was historic in itself. This decision was given by the double bench of Justice Nagarathna and Justice Augustine George Masih.
While giving this decision, the Supreme Court said that not only slim women, women of any religion are entitled to maintenance. The Supreme Court said that under Section 125, a woman can file a maintenance case against her husband. Religion is not a hindrance in this. The Supreme Court also gave the right to maintenance allowance to Muslim women, said – religion is not a hindrance. Justice BV Nagarathna in the Supreme Court said that now the time has come that Indian men should recognize the role and sacrifice of a housewife for the family. They should provide him financial support by opening joint accounts and ATMs.

The Supreme Court on Wednesday drew a big line on the maintenance of women and said that religion is not a hindrance in this. The court also fixed the husband’s responsibility for maintenance for Muslim women. Let us tell you that a woman from Telangana had approached the Supreme Court for maintenance. Who is Justice Bibi Nagarathna?
Justice Bibi Nagarathna was born on 30 October 1962. His father Justice ES Venkataramaiah was also the 19th Chief Justice of India between 19 June 1989 and 17 December 1989. Justice BV Nagarathna has done LLB from the Law Department of Delhi University. After completing her studies, BV Nagarathna started her law career as a lawyer on 28 October 1987 in Bengaluru. He was appointed an additional judge of the Karnataka High Court on 18 February 2008 and was made a permanent judge on 17 February 2010.
Nearly 13 years of tenure of BV Nagarathna as a High Court judge has been completed and in the year 2021, when the Supreme Court Collegium recommended 9 names to the Central Government for the vacant vacancy in the court, Justice BV Nagarathna was among them. Name was also included. After this, Biwi Nagarathna became the Justice of the Supreme Court.
Who is Justice Augustine George Masih?
Justice Augustine George Masih is originally from Ropar, Punjab. Justice Augustine George Masih, born on 12 March 1963 in Ropar, received his early education from St. Mary’s Convent School, Kasauli, Himachal Pradesh. He also studied from Saifuddin Tahir High School, Aligarh. Graduated in Science Faculty from Aligarh Muslim University. After this, he took LLB degree. Justice Augustine George Masih got enrolled in the Punjab and Haryana Bar Council on 6 June 1987. Justice Augustine George Masih practiced on both the original appellate sides, including constitutional, service, labor and civil law. He has experience of working in many High Courts including Supreme Court, Punjab and Haryana High Court, Delhi High Court, Himachal Pradesh.
