According to the Tenth Schedule of the Constitution of India, specifically paragraph 2 (1) (a), a member of the House belonging to any political party is disqualified from membership of the House if the member of the House voluntarily leaves the party. . In such a situation, Congress MLAs Batra and Ahmed Chaudhary had demanded disqualification of Kiran Chaudhary. A reminder was also sent to the Assembly after a few days.

According to the statement, the Legislative Assembly Secretariat clarified that a petition has been filed before the Assembly Speaker for such a demand, while the Congress leaders only sent a notice demanding disqualification of Kiran Chaudhary as a member of the House. .
The ‘Disqualification of Members on Ground of Defection Rules, 1986’ clearly states that a petition seeking termination of membership of an MLA shall be signed by the petitioner and verified in the manner prescribed in Part 5 of the Code . If the petition does not meet the criteria under the prescribed rules, the Speaker of the Assembly can reject it.
Speaker rejected Congress’ petition

MLAs Ahmed and Batra had last month said that Kiran Choudhary was selected as a Congress candidate and now he has voluntarily given up his membership by joining BJP, hence he is ineligible under the provisions of the Tenth Schedule.
He has been clearly disqualified and cannot be counted as a Member of the Legislative Assembly for any intent and purpose on June 19, 2024.
